SAVREQ Service Purchase Terms (Automatic Shooting Service)
These terms of use (hereinafter referred to as the "Terms") set forth the terms and conditions of use of the video footage management and data provision service (hereinafter referred to as the "Service") provided by LOTTE Hotel Arai Co., Ltd. (hereinafter referred to as the "Company") for a fee or free of charge using the cloud-based automatic shooting/online lesson service "SAVREQ" (hereinafter referred to as the "SAVREQ") provided by TOSYS Corporation.
Article 1 (Service Overview)
This service is a service that links the camera equipment installed by the Company with SAVREQ, stores and manages video data of the user of this service (hereinafter referred to as "user") himself on the cloud service, and provides the user with the right to download the video data.
Article 2 (Scope of application)
This agreement shall apply to the scope of services in which transactions or agreements have been confirmed between the Company and users on the SAVREQ service. In addition, as long as there is no priority in this agreement, it is assumed that you agree that the "SAVREQ Terms of Use" will be applied as a premise of using this service.
Article 3 (Establishment of service contract)
The contract for this service shall be concluded when the user uses the SAVREQ service to apply for the purchase of the service to the Company (including the purchase processing by the payment agency service or the payment processing of the fee by other methods), and the service contract is established at the time when the Company receives the notification. In addition, unless there is a reason attributable to our company, we will not refund the fees paid.
Article 4 (Restriction of Use and Termination of Contract)
The Company may, without prior notice, restrict the use of all or part of the Service to the User or terminate the Service Agreement in any of the following cases. In addition, the Company shall not be held responsible for any damage caused to the user by this.
(1) In case of violation of any provision of these Terms
(2) When it turns out that there is a false fact in the registered items
(3) When one year has passed since the contract for this service was concluded
(4) When the data of the service is deleted due to the user's operation or other reasons
(5) When the user's SAVREQ user registration is canceled due to the user's operation or other reasons
(6) When TOSYS Co., Ltd. terminates the provision of the SAVREQ service;
(7) In addition, when the Company determines that the use of this service is not appropriate.
Article 5 (Sharing of User Information)
According to the provisions of Article 3 of this agreement, when a service usage contract is established between the user and the Company, the user's registration information and usage information on SAVREQ shall be shared with the Company on the system. In addition, users are deemed to have agreed to the application of the SAVREQ Terms of Use.
Article 6 (Prohibitions)
When using this service, the user shall not do the following acts.
(1) Acts that violate laws or public order and morals ・Acts related to criminal acts
(2) Actions that destroy or interfere with the functions of our server or network
(3) Acts that may interfere with the operation of the Company's services
(4) Acts of unauthorized access or attempts to do so
(5) Acts of collecting or accumulating personal information, etc. related to other users
(6) Acts of disclosing information that violates portrait rights or privacy of third parties;
(7) Unauthorized acquisition of pre-purchase videos or still images by means of screenshots, etc.
(8) Other acts that the Company deems inappropriate
Article 7 (Suspension of Provision of the Service, etc.)
If the Company determines that there is any of the following reasons, the Company may suspend or suspend the provision of all or part of the Service without prior notice to the User. In addition, the Company shall not be liable for any disadvantage or damage suffered by the user or a third party due to the suspension or interruption of the provision of this service, regardless of the reason.
(1) When performing regular or urgent maintenance and inspections to provide services
(2) When the operation of the service becomes impossible due to an emergency such as fire, power outage, natural disaster, etc.
(3) When the operation of the service becomes impossible due to war, civil war, riot, disturbance, labor dispute, etc.
(4) When the service cannot be provided due to poor service or unauthorized access from a third party, etc.
(5) When the service cannot be provided due to measures based on laws, regulations, etc.
(6) In addition, when the Company determines that it is unavoidable.
Article 8 (Cancellation)
The User may terminate this Service Agreement at any time by withdrawing from the SAVREQ user registration or deleting the data for the service purchased on the SAVREQ Service.
Article 9 (Disclaimer)
The Company does not guarantee the safety, reliability, accuracy, effectiveness, suitability for a particular purpose, security-related defects, errors, bugs, or infringement of rights with respect to the functions, data, and information provided by the Service. Users shall agree to the matters described below and use this service at their own risk.
(1) In no event shall we be held responsible for any loss of data or other troubles.
(2) All settings, etc. of personal computers, mobile terminals and other devices for using this service shall be carried out at the user's own responsibility. The Company shall not be held responsible for any malfunctions of terminals, etc. that occur as a result of using the Service.
(3) All communication costs incurred in using this service shall be borne by the user.
(4) All issues of privacy or portrait rights of third parties arising from the use of this service shall be handled at the responsibility of the user, and the Company shall not assume any responsibility.
(5) When using this service, the Company shall not be held responsible for any accidents or troubles that occur during filming within the service providing facility.
(6) In addition, the Company shall not be held responsible for any damages to the user arising from the use of this service, or any transactions, communications or disputes arising between the user and the service providing facility or a third party.
Article 10 (Changes to Service Contents, etc.)
The Company shall be able to change the contents of this service or stop providing this service by notifying the user in accordance with the provisions of Article 12 of this agreement. The Company shall not be held responsible for any damage caused to the user by this.
Article 11 (Changes to Terms of Use)
If we deem it necessary, we may change this agreement by notifying the user according to the provisions of Article 12 of this agreement. In addition, if the user starts using this service after changing this agreement, it is assumed that the user has agreed to the changed agreement.
Article 12 (Notice or Contact)
In principle, notices or communications from the Company to users shall be made by posting on the Company's page on the SAVREQ official website. When using this service, the user shall confirm the content posted on the official website, and the notice from the Company to the user shall be deemed to have reached the user at the time when the user uses this service, and the user shall consent to this.
Article 13 (Handling of personal information)
The Company shall appropriately handle personal information obtained through the use of this service in accordance with the Company's privacy policy.
Article 16 (Governing Law/Jurisdiction)
The law of Japan shall be the governing law for the interpretation of these Terms. In the event of any dispute regarding this service, the court having jurisdiction over the location of our head office shall be the exclusive jurisdictional court.

The Company shall be able to change the contents of this service or stop providing this service by notifying the user in accordance with the provisions of Article 12 of this agreement. The Company shall not be held responsible for any damage caused to the user by this.
Article 11 (Changes to Terms of Use)
If we deem it necessary, we may change this agreement by notifying the user according to the provisions of Article 12 of this agreement. In addition, if the user starts using this service after changing this agreement, it is assumed that the user has agreed to the changed agreement.
